Our services encompass a broad range of digital marketing, technology, and automation offerings designed to help water-based businesses attract customers, streamline operations, and grow revenue.
Our core service offerings include professional website design and development, digital marketing strategy and execution, AI-powered automation tools and chatbot integration, online booking and reservation system implementation, review management and reputation monitoring, search engine optimization (SEO), social media management, and other related digital services as described on the Site or in individual service agreements.
The specific scope, deliverables, timelines, and pricing for services are defined in individual service agreements, proposals, or statements of work entered into between BurtSide and the client. The Site provides general information about our capabilities and is not itself a binding offer to perform any specific services. We reserve the right to modify, expand, or discontinue any of our service offerings at any time without prior notice.
As a user of the Site and our services, you agree to provide accurate, current, and complete information whenever prompted or required, whether during account creation, service onboarding, or any other interaction with BurtSide. You are responsible for maintaining the accuracy of all information you provide and for updating it promptly if any changes occur.

Payment terms, fees, billing schedules, and accepted methods of payment for all services provided by BurtSide AI Agency LLC are outlined in individual service agreements, proposals, or statements of work executed between BurtSide and the client. By entering into a service agreement, you agree to pay all fees associated with the services you have selected in accordance with the terms specified in that agreement.
Unless otherwise stated in a service agreement, all invoices are due and payable within the timeframe specified on the invoice or in the corresponding agreement. Payments not received by the due date may be subject to late fees of up to 1.5% per month or the maximum rate permitted by applicable law, whichever is lower. BurtSide reserves the right to suspend or terminate services for any account with outstanding balances past due by thirty (30) days or more.
All fees are quoted and payable in United States Dollars (USD) unless otherwise specified. You are responsible for any applicable taxes, duties, or government-imposed fees associated with the purchase of services. BurtSide is not responsible for any fees charged by your bank or payment processor. Refunds, if applicable, are handled in accordance with the terms of the individual service agreement.
All content, features, functionality, software, code, designs, templates, proprietary tools, systems, methodologies, trade names, trademarks, service marks, and other intellectual property displayed on or used in connection with the Site and our services are the exclusive property of BurtSide AI Agency LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Any content, materials, data, images, text, or other assets provided by the client ("Client Content") remain the sole property of the client. By providing Client Content to BurtSide, you grant us a non-exclusive, revocable license to use, reproduce, modify, and display such content solely for the purpose of performing the agreed-upon services. This license terminates upon the conclusion or termination of the applicable service agreement, except as necessary for BurtSide to maintain backups or comply with legal obligations.
Upon full payment for delivered work, BurtSide grants the client a non-exclusive, non-transferable license to use the deliverables as specified in the applicable service agreement. Unless explicitly stated otherwise in writing, BurtSide retains ownership of all underlying code frameworks, templates, tools, and systems used to create the deliverables. The client may not sublicense, resell, or redistribute any proprietary BurtSide tools, templates, or systems without our express written consent.
To the fullest extent permitted by applicable law, BurtSide AI Agency LLC, its officers, directors, members, employees, agents, affiliates, and contractors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, revenue, goodwill, data, or other intangible losses, arising out of or in connection with your use of (or inability to use) the Site or our services, even if BurtSide has been advised of the possibility of such damages.
In no event shall BurtSide's total aggregate liability to you for all claims arising out of or related to the Site or our services exceed the total amount actually paid by you to BurtSide for the specific services giving rise to the claim during the twelve (12) months immediately preceding the event that gave rise to such liability.
BurtSide does not warrant that the Site will be available at all times, uninterrupted, or error-free. We do not guarantee specific results from the use of our services, including but not limited to increases in website traffic, search engine rankings, booking volumes, or revenue. Any estimates, projections, or forecasts provided are for informational purposes only and do not constitute guarantees of performance. You acknowledge that results from digital marketing and AI-based services can vary based on numerous factors outside of our control.
Either party may terminate an individual service agreement in accordance with the termination provisions set forth in that agreement. In the absence of specific termination provisions, either party may terminate a service agreement by providing thirty (30) days' written notice to the other party.
BurtSide reserves the right to suspend or terminate your access to the Site and refuse any and all current or future use of our services, in whole or in part, at our sole discretion and without prior notice or liability, for any reason, including but not limited to a breach of these Terms, non-payment of fees, fraudulent or abusive conduct, or any behavior that we reasonably believe may cause harm to BurtSide, our systems, or other users.
Upon termination of services, BurtSide will make reasonable efforts to provide the client with copies of any completed deliverables for which full payment has been received. Any outstanding balances for services rendered prior to termination remain due and payable. Provisions of these Terms that by their nature should survive termination shall remain in full force and effect, including but not limited to intellectual property provisions, limitation of liability, indemnification, and governing law.
These Terms and Conditions, and any disputes arising out of or related to these Terms, the Site, or our services, shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.
Any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the state or federal courts located in the Commonwealth of Virginia, and you hereby consent to the personal jurisdiction of such courts and waive any objection to venue in such courts. You agree that any cause of action arising out of or related to the Site or our services must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred.
BurtSide AI Agency LLC reserves the right to modify, amend, or replace these Terms and Conditions at any time and at our sole discretion. For clients under active service agreements, material changes to these Terms will be communicated via email to the address on file. In the event of a conflict between these Terms and an individual service agreement, the terms of the service agreement shall prevail.
